Terms of Service

These Terms govern your use of the KiwiPages application (the "App") on a Shopify store you own or operate. By installing the App you agree to these Terms.

1. The service

KiwiPages is a Shopify-embedded landing-page builder. The App provides a visual editor, a template gallery, optional AI-assisted block generation, an importer for HTML and external URLs, basic analytics, and tools to publish pages onto your Shopify storefront.

2. Your responsibilities

• You must own or be authorised to use the Shopify store on which you install the App.
• You must own or be authorised to use any content you create, paste, upload or import into the App. Every import action requires you to attest ownership; the App records that attestation for audit purposes.
• You are responsible for the content of pages you publish, including any claims, prices, disclaimers, cookie banners or other requirements imposed by your jurisdiction.
• You acknowledge that AI features bundled with the App transmit your prompts, the section content being transformed, and (for the chat widget) shopper messages to our AI provider (DeepSeek). See the Privacy Policy for the full data flow.

3. Prohibited use

You agree not to use the App to:

• Publish content that infringes intellectual property or other rights of third parties.
• Publish content that is unlawful, deceptive, misleading, defamatory, obscene, or that promotes hate or violence.
• Scrape, mirror or republish copyrighted material via the URL or HTML importer without the rights holder's permission.
• Attempt to circumvent the App's security controls, rate limits, allow-lists or attestation requirements.
• Resell or sublicense the App as a standalone service to third parties.

4. AI features

The App ships with AI features (smart import, AI block generation in the editor, on-page chat widget). These features are powered by a single bundled provider (DeepSeek) — there is no API key for you to configure and no per-use charge passed on to you. By using an AI feature, you agree that the relevant content (the prompt you type, the HTML/CSS being transformed, the URL being imported, and — for the chat widget — the shopper's message and the visible page text) is transmitted to DeepSeek's API for processing. 5. Service availability

The App is provided on an "as is" and "as available" basis. We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and upstream issues with Shopify or other sub-processors may affect availability.

6. Fees

Pricing, if any, is shown in the Shopify App Store listing at the moment of install. If the App is offered free of charge during a beta period, we reserve the right to introduce paid plans at a later date, with prior notice and the ability for the merchant to opt out by uninstalling.

7. Termination

You can stop using the App at any time by uninstalling it from your Shopify admin. On uninstall we delete your data as described in our Privacy Policy. We may suspend or terminate access to the App if we determine, in good faith, that you have materially breached these Terms.

8. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with your use of, or inability to use, the App. Our total liability under or in connection with these Terms shall not exceed the fees you have paid us, if any, in the twelve months preceding the event giving rise to the claim.

10. Indemnity

You agree to indemnify and hold us harmless from any claim, demand or damages, including reasonable attorneys' fees, arising out of (a) your use of the App, (b) content you publish or import with it, or (c) your breach of these Terms.

11. Changes

We may revise these Terms from time to time. Material changes will be flagged in the admin app or by email to the merchant of record. Continued use of the App after such notice constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of Italy. Any dispute arising from them is subject to the exclusive jurisdiction of the courts of the province of the operator's registered address, unless mandatory consumer law provides otherwise.
